These Terms and Conditions (“Referral Terms”) govern participation in the MagicMarkets Referral Rewards Program (“Program”) operated by 3-102-947650 SRL, a company incorporated in Costa Rica (“MagicMarkets”, “we”, “us”, “our”).

By participating in the Program, you agree to be bound by these Referral Terms, as well as MagicMarkets’ general Terms of Service, Privacy Policy, and any other applicable policies, all of which are incorporated herein by reference.

MagicMarkets reserves the right to amend, suspend, or terminate the Program at any time and at its sole discretion.

1. Eligibility

1.1. To participate in the Program as a referrer, you must:

• Hold a MagicMarkets account in good standing;
• Be of legal age to engage in sports betting in your jurisdiction of residence; and
• Comply with all applicable laws and regulations in your jurisdiction regarding referral arrangements and sports betting.

1.2. Participation in the Program is subject to MagicMarkets’ ongoing right to verify eligibility. MagicMarkets reserves the right to exclude any account from the Program at its sole discretion.

2. Referral Links

2.1. Eligible participants will be issued a unique referral link (“Referral Link”) through their account dashboard.

2.2. A “Referred User” is a new customer who: (a) registers a new MagicMarkets account using your Referral Link and completes all required account opening procedures; and (b) is confirmed as a unique, eligible customer not previously known to MagicMarkets.

2.3. Referral attribution is determined solely by MagicMarkets’ tracking systems. MagicMarkets’ determination of attribution is final.

2.4. You may share your Referral Link through personal channels in a manner consistent with these Referral Terms. You must not:

• Publish your Referral Link through paid advertising or any media that implies endorsement by or affiliation with MagicMarkets without prior written consent;
• Use spam, unsolicited messaging, misleading representations, or any deceptive method to distribute your Referral Link;
• Offer any inducement, side-payment, or arrangement to prospective Referred Users in connection with your Referral Link;
• Create fake or duplicate accounts, or engage in any fraudulent or manipulative activity in connection with the Program; or
• Make any representation about the Program or its rewards that MagicMarkets has not expressly authorised.

3. Dividend Pool and Referral Dividends

3.1. Each calendar month, MagicMarkets will establish a dividend pool (“Dividend Pool”). The Dividend Pool is funded by reference to overall trading activity on the platform by Referred Users during that month.

3.2. The methodology for calculating the Dividend Pool — including the precise formula, rates, and any adjustments — is proprietary to MagicMarkets and will not be disclosed. MagicMarkets retains full discretion over the size, composition, and distribution of the Dividend Pool.

3.3. Referrers who have at least one active Referred User generating qualifying taker volume during a calendar month are eligible for a share of that month’s Dividend Pool (“Referral Dividend”).

3.4. Each eligible referrer’s share of the Dividend Pool is proportional to the taker volume generated by their Referred Users relative to the total qualifying taker volume across all eligible referrers during the same period. “Taker volume” means the notional value of bets placed by a Referred User in the capacity of a taker on the MagicMarkets exchange, as recorded in MagicMarkets’ systems.

3.5. MagicMarkets reserves the right to exclude specific transactions or volume from the calculation of the Dividend Pool or individual allocations where it reasonably suspects abuse, error, or activity that is inconsistent with the spirit of the Program or MagicMarkets’ general Terms of Service.

3.6. Referral Dividends are calculated and credited to referrers’ MagicMarkets accounts within ten business days following the end of each calendar month. Dividends will appear in a participant’s transaction history as a “Referral Dividend”.

3.7. Referral Dividends are credited in USDT and are subject to applicable withdrawal terms set out in MagicMarkets’ general Terms of Service.

3.8. The Dividend Pool may be zero in any given month, in which case no Referral Dividends will be paid for that month. There is no guaranteed minimum dividend.

4. Referred Users

4.1. MagicMarkets reserves the right to refuse, suspend, or terminate any Referred User’s account at its sole discretion and without notice, in accordance with its general Terms of Service or for any other reason, including but not limited to fraud prevention, responsible gambling obligations, or regulatory requirements.

4.2. No Referral Dividend will accrue in respect of a Referred User’s activity following the suspension or termination of their account. MagicMarkets shall have no liability to a referrer arising from any decision to refuse, restrict, or terminate a Referred User’s account.

4.3. MagicMarkets makes no representation that any Referred User will remain active on the platform or generate any particular volume of trading activity.

5. No Guarantee of Reward

5.1. Participation in the Program does not guarantee any Referral Dividend. The existence, size, and distribution of the Dividend Pool are entirely at MagicMarkets’ discretion.

5.2. MagicMarkets makes no representation that the Program will continue for any specified period or that any particular level of reward will be available.

6. Responsible Gambling

6.1. MagicMarkets is committed to responsible gambling. The Program is not intended to encourage excessive gambling by referrers, Referred Users, or any other person.

6.2. MagicMarkets reserves the right to exclude from the Program any account associated with a customer who has self-excluded, requested a cooling-off period, or is subject to responsible gambling restrictions.

7. Fraud and Abuse

7.1. Any attempt to manipulate, exploit, or abuse the Program — including but not limited to creating fictitious accounts, coordinating artificial trading activity, or misrepresenting referral activity — will result in immediate disqualification, forfeiture of any accrued dividends, and may result in suspension or termination of your MagicMarkets account.

8. Limitation of Liability

8.1. To the maximum extent permitted by applicable law, MagicMarkets shall not be liable for any loss of anticipated Referral Dividends, indirect, consequential, or special losses arising from participation in or exclusion from the Program. Nothing in these Referral Terms limits MagicMarkets’ liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.

9. Governing Law

9.1. These Referral Terms shall be governed by, and construed in accordance with the laws of Anjouan, Union of the Comoros.

9.2. Any and all disputes, claims, or controversies arising out of or in connection with these Referral Terms, including but not limited to formation, validity, performance, or termination, shall be subject to the exclusive jurisdiction of the courts of Anjouan. The parties irrevocably submit to the exclusive jurisdiction of such courts and agree to bring any legal action or proceeding exclusively before them.
